Who we are
Nixis is made and sold by Gander Labs, a sole proprietorship in Ontario, Canada. When these terms say “we” or “us”, that’s who we mean. “You” means the person or business using Nixis.
What Nixis is
Nixis is a video player app, plus this website where you manage it. That’s all it is. We don’t supply any channels, streams, playlists, movies or shows. Whatever plays in Nixis comes from a login or playlist you bring yourself, and it goes straight from your provider to your device. It never passes through us.
Because we don’t supply what you watch, we can’t vouch for it either. Your provider is responsible for their service, and you’re responsible for choosing one you’re allowed to use.
Your account
- You need to be at least 18, or the age of majority where you live, to make an account or buy a plan.
- Keep your email account safe. Anyone who can read your email can sign in to Nixis as you.
- If you set up Nixis for a business, you’re agreeing to these terms on that business’s behalf.
- You’re responsible for what happens on your account and on the devices paired to it.
Using it fairly
Only use Nixis with logins and playlists you have the right to use. Our acceptable use policy spells out what that means. If we find an account or business using Nixis to share content it isn’t licensed to share, we’ll close it, and there’s no refund when that happens.
Plans and paying
- You pay per device, on this website. We never sell anything on the TV.
- Payments are handled by Stripe. Prices are shown before you pay, along with any tax.
- Monthly and yearly plans renew on their own until you cancel. If your plan starts with a free trial, your card is charged when the trial ends unless you cancel first.
- When you cancel, your plan keeps working until the end of the time you’ve already paid for, then stops. We don’t charge you again.
- Adding a device partway through is charged for the time left on your plan. Removing one takes effect when your plan renews.
- A lifetime plan is paid once and lasts for as long as we keep Nixis running.
Price changes
We may change our prices. If we do, we’ll tell you at least 30 days ahead, and your current price stays the same for at least 12 months after the change is announced.
Refunds
You can get a full refund within 14 days of your first purchase. The details are on our refunds page.
If you live in the EU or the UK, you normally have 14 days to withdraw from an online purchase. Nixis starts working the moment you pay, so when you check out you agree that the service starts right away and that you give up that withdrawal right. Our own 14-day refund still applies.
When a plan ends
If your plan runs out, your devices stop playing but nothing is thrown away. We keep your devices, logins and profiles for 12 months in case you come back. After that, we may delete them.
Closing an account
You can stop using Nixis at any time. We can suspend or close an account that breaks these terms or our acceptable use policy, or that puts other people or our service at risk. Where it’s fair to, we’ll warn you first.
The app itself
Nixis, its name, look and code belong to us. Your plan lets you use the app on the devices you pay for. You can’t copy, resell or take apart the app, or try to get around how plans and devices are counted. If you’re a reseller, you can put your own name and colors on the screen, but the app underneath is still ours.
No guarantees
We work hard to keep Nixis running well, but we provide it “as is”. We can’t promise it will always be available, error-free, or work with every provider or device. We sometimes change, add or remove features.
Limits on our liability
As far as the law allows, we aren’t responsible for indirect losses, lost profits or lost data, or for anything your provider does. Our total responsibility to you for any claim is limited to what you paid us in the 12 months before it. Nothing here takes away rights you have under consumer law that can’t be signed away.
Changes to these terms
If we change these terms in a way that matters, we’ll email you before the change takes effect. If you keep using Nixis after that, you’re agreeing to the new terms.
The law that applies
These terms are governed by the laws of Ontario and of Canada that apply there. If you’re a consumer, you also keep any protections the law where you live gives you.
